Under the authority of an act of the legislative assembly, approved January 17, 1887, the governor, with the advice of the council, appointed a commission to revise the laws of the territory. The commissioners were directed by the statute to eliminate "all crude, useless, imperfect and contradictory matter, and insert such new provisions as they might deem necessary and proper." They were also required to "complete the work of revision on or before the fourth day of March, 1887," and as soon as they "prepared the law upon any particular subject," they were to " report the same to the legislature for examination and approval.'' The governor had called attention to the voluminousness of the statutes, and the conflicting and inharmonious provisions which they contained, and in his message to the legislative assembly said: "The statutes of the territory were last compiled in 1877. Since then many amendments have been made to old laws, and many new laws passed, so that what is the present law can only be ascertained by a careful examination of the different session laws enacted for ten years past. I therefore recommend that a commission be created to revise the laws, print and publish the same for the use of the county and territorial officers, and supply, at a reasonable price, sufficient copies to members of the bar and others desiring them, thus covering the cost of compilation." The Compiled Laws of 1877 and the statutes of 1879 to 1885 inclusive, embraced one thousand seven hundred and ninety-seven pages of closely printed matter. The commission fully appreciated the arduous character of the undertaking and the close and laborious application which would be necessary in order to complete the task within the period of the forty-five days allowed under the act.
